&quot;On behalf of Andrea Collins and the Citizens for Safe Technology Society (&quot;the Complainants&quot;), the following is submitted in reply to BC Hydro's submissions dated April 25, 2012, in the context of our reconsideration application with respect to the above-referenced matter.

A. Operation of the UCA by default
BC Hydro asserts that the CEA exemption was meant to capture the smart meter
system. We agree. This issue arises because there are two kinds of smart meter
systems: hard-wired systems and wireless systems, the latter of which are
accompanied by a host of health and environmental concerns.
&quot;The Legislature and Cabinet knew, at all material times, that both these options
existed. If it was intended that the exemption apply to the wireless option, why did
the Legislature and Cabinet fail to make a specific reference in that regard - either
by describing a system that includes a wireless component or by wireless
functionality?
&quot;The failure of the Legislature and Cabinet to bring, by explicit reference, wireless
communication technology into the scope of the CEA exemption, results, by
default, in the application of the UCA's CPCN requirement.  We advance this assertion based on the following reasoning . . .</description>

&quot;In her income tax return, the plaintiff claimed expenses of 17,075 euro for the installation of RF radiation shielding to protect her condominium against broadcast, TV, and cell phone radiation. The revenue office declined the deduction of these expenses as exceptional expenditures because no certificate by a medical officer regarding the necessity of such shielding had been supplied and therefore could only be considered as a precautionary measure. &quot;The 10th Senate of the Finance Court Cologne took another view and allowed the deduction as medical expenditures. Necessary, and thus tax deductible, are not only medically inevitable expenditures within the meaning of minimum provisions, but rather expenditures of any diagnostic or therapeutic treatments whose application is sufficiently justified in the case of disease. To prove that the installation of the shielding was necessary, the Court was satisfied with a certificate by a medical doctor in private practice regarding the plaintiff's advanced electromagnetic hypersensitivity, and an expert report by a building biology engineer about the RF radiation exposure levels of &quot;considerable concern&quot; within the completed building envelope of the condominium.  
&quot;According to the Senate's ruling, no appeal against its decision can be filed with the Federal Finance Court.

The B.C. Utilities Commission's dismissal of a complaint by an anti-smart meter group trying to put a stop to BC Hydro's installation of the meters will only serve to move the complaint to the next level, the group says.
Citizens for Safe Technology executive director Una St. Clair said it is just the beginning, not the end, of her group's war against the wireless meters Hydro is intent on rolling out in B.C.
&quot;We have expected this to go to appeal,&quot; she said Monday. &quot;This is no surprise to us. We're trying to get it into the B.C. Court of Appeal, where we feel it has more chance to be reviewed properly.&quot;
St. Clair said that in a context in which both the Union of B.C. Municipalities and 34 individual municipalities have called for a moratorium and/or an opt-out choice for those who oppose smart-meter deployment, the BCUC decision calls into question the commission's effectiveness as both a protector of the public and an independent voice respecting democratic process.
&quot;Those municipalities represent some two million people,&quot; St. Clair said. &quot;There are around 4.5 million in B.C. That's almost half of the population saying the meter deployment should be reviewed.&quot;
CST applied to the commission in late December seeking a &quot;freeze&quot; on the installation of wireless electricity consumption meters. Lawyer David Aaron argued that while the province's Clean Energy Act exempts the installation from commission approval, the legislation doesn't cover the &quot;wireless and snooping component of the smart meter program.&quot;
The commission found the term &quot;snooping&quot; referred to a radio chip in each meter that would only be activated if the customer wishes to install an in-home feedback device to show electricity consumption readings from the meter on a small wall display.
The commission also noted that the provincial legislation did not prescribe any particular kind of meter, but left the technical details to BC Hydro engineers.
But St. Clair tore into the commission's decision.

begin taking legal action against her. Today, someone from B.C. Hydro (604-549-2801 on her call display) called. 
It is a call-out line only, as when I attempted to contact the person 
threatening my mother with legal action by BC Hydro, it did not go 
anywhere. I have attempted to call BC Hydro, but it is an endless loop, with them dropping my call while I waited for a representative from BC Hydro to connect with me.  Of course they first got the account number entered by the 
touch tone phone, so now I am very concerned what else they have planned 
for her, and others like her. So the 'monsters are raising their ugly heads in quiet corners' away from the 
eyes of the general public. This is unacceptable, frightening citizens in the privacy of their own homes, 
using the phone line as a portal of deception and a tool against people . . .&quot; &lt;em&gt;Response:It is most likely Corix, the meter installers your mother is dealing with. You need to call their head office and call their bluff with abuse of power, intimidation and uttering threats. Then they should be reported to BC Hydro. You need to get a name, so, if you talk to someone, make sure you get their details. They are not BC Hydro, but may be representing themselves as such. BC Hydro has stated that there will be no forcing people until December 2012. By then we hope to have legal action underway.
Most importantly, you need to take this to the media also. Can you call the local editors of Vancouver Sun, Province and any local paper? Especially as it is your mother being intimidated and harassed. Your mother should get a number to call back and refuse to enter into a dialogue with them, stating you are in charge of her hydro account.&lt;/em&gt;</description>
